Gary Wolensky | Partner

Gary Wolensky’s practice is focused on the defense of manufacturers and retailers in their commercial and product liability litigation and regulatory matters, particularly in the automobile, motorcycle, consumer goods, football equipment and sporting goods, medical device, food and amusement park industries. Currently, Gary’s practice is focused on handling class actions of all types including consumer fraud, breach of warranty and employment class actions.

Gary has successfully defended complex cases involving catastrophic traumatic brain injuries including subarachnoid hemorrhages, subdural hematomas, diffuse axonal injuries, carotid artery and vertebral dissections. He is also heavily involved in concussion litigation and regulatory issues and represents helmet manufacturers in these areas. Gary has also been involved in numerous cases involving spinal injuries that resulted in quadriplegia, tetriplegia and paraplegia and has worked with many of the top researchers and consultants on head and spinal issues.

Gary has been lead trial counsel in numerous catastrophic personal injury, product liability, and commercial cases and class actions and currently serves as National and Regional counsel for several international companies. He works closely with national industry associations in the development of test standards and medical causation defenses.  Finally, he consults with manufacturers and agencies regarding regulatory compliance, including possible and actual recalls, as well as FTC investigations and potential prosecutions.

Gary’s medical background stems from being required many years ago to attend classroom courses for first year medical residents in order to defend a hospital in its medical malpractice litigation.  Since then, he has also defended numerous medical device companies that manufacture scores of products including prosthetics, pedicle screws and replacement knees, hips and shoulders.

Gary has worked with companies of all sizes on the development of product warnings, instructions, instruction manuals, and risk management programs. He believes that well-crafted warnings, instructions, marketing and advertising, both in print and social media can avoid nightmare investigations, prosecutions, and litigation.  In addition, Gary has assisted many companies with the interpretation of and compliance with the Consumer Product Safety Improvement Act of 2008 and was involved in meetings and numerous communications with the Consumer Products Safety Commission concerning interpretation of the new Act in 2008 and 2009.

Gary has been featured on Fox Business Network and nationally-syndicated radio to discuss implications of various new laws and relevant new legal decisions.
